NY ULSTER — The Zoning Board of Appeals unanimously denied a variance for a two-story garage with accessory dwelling unit on Catskill Avenue. Applicants Clarence Hayes III and Ann M. Hayes sought a 92.5 percent reduction in the required 20-foot side-yard setback, proposing placement just 1 foot 6 inches from the property line, along with a 58 percent reduction in the 25-foot rear-yard setback.
Chairman Kevin Reginato, joined by board members Richard Anderson and Megan Higgins, determined the variance was substantial, the hardship self-created, and the structure could be relocated to comply with code. The board also approved a variance for Susan Provost for a 6-foot fence and referred two other requests to public hearing.
